WASHINGTON, D.C. – Congressman Clay Higgins (R-LA) voted to pass H.J. Res. 44, which overturns a Biden Administration Bureau of Alcohol, Tobacco, and Firearms, and Explosives (ATF) rule that classifies a firearm and stabilizing brace as a short-barreled rifle making it subject to regulation.
This new ATF rule contradicts the prior 2012 determination made during the Obama Administration – which many individuals, including disabled Veterans, relied upon – that firearms equipped with a stabilizing brace would not be subject to NFA control.
“For a decade, the ATF rule allowed braced pistol purchases. About 30 million Americans legally purchased ‘braced’ firearms, including me,”said Congressman Higgins. “Then, unbelievably, in January 2023, the Biden ATF just summarily changed the rule, RETROACTIVELY making braced pistols technically become ‘short barrel rifles,’ which are heavily restricted and regulated in America. A SBR requires a special ATF license. Those licenses are difficult to apply for and are commonly denied by ATF. So, in an unprecedented act of federal regulatory oppression, iPOTUS effectively turned millions of law-abiding Americans into federal firearms felons. This bill slaps some reality back into the WH. We, the People, reversed his unconstitutional executive action. And Biden is well advised to sign the bill when it hits his desk, because We’re watching.”
